Acceptance of Terms

By accessing and using our SendMachine.com web site ("SendMachine Service" and “SendMachine App"), and all services of Sendmachine SRL, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Anti Spam Policy govern Sendmachine SRL relationship with you. If you don't agree to these Terms or our Anti Spam Policy, please don't use the Service or the Website.

Service description

This service gives users access to the email transmission Service “SendMachine”, any new feature introduced will be subject to these Terms. To use the Service, you must have acces to the internet (world wide web), either directly or through devices that can access web content, and to pay the related fees for the service. In addition, you must have the equipment necessary to connect to the Internet, including a computer and modem or other access device.

Billing

Sendmachine will periodically issue proforma invoices for the provided services which you will have to pay in advance. Payment frequency is monthly. Payment is made in lei at the exchange rate of the day of issue of invoice and is non refundable. If your invoice is not paid on time Sendmachine has the right to suspend or stop providing the Service without notice.

Privacy and Communication

In order to use the SendMachine Service and App, you must provide an valid e-mail address, we will use your e-mail address to identify you as a unique subscriber and provide you with service related information. You agree to receive communications from us regarding the Service by email occasionally, including notices if applicable.

Account Security

You are responsible for maintaining the confidentiality of your username and password. You will notify us immediately of any unauthorized use, or other security breach to your Account. We will not be liable for any loss that you incur as a result of someone else using your username or password.

Email Practices

Every email sent with SendMachine Service and App must comply with our Anti Spam Policy. Sendmachine SRL reserves the right to terminate any account that it finds in violation of its Terms of Use by receiving abuse complaints higher than allowed, without refund.

Sendmachine SRL reserves the right to either suspend or terminate the acces to the Service, without notice, if we determine, in our sole discretion, that you have breached or will likely breach any of these Terms of Use or our Anti Spam Policy, including failure to provide accurate information, pay your invoice on time, receiving abuse complaints higher than allowed, without refund.

Pricing

All our fees are listed on the website in the admin panel and do not include VAT. We reserve the right to change prices of our services without any notice. We will not issue, under any circumstances, cash refunds for early contract cancellation

Credits availability

Credits or the number of emails that can be sent, specific to each package, are valid for 1 month from activation date. Unused credits in this period will not be reported in the next month.

Limitation of Liability

In no event shall Sendmachine SRL be liable for any indirect, incidental, special, or consequential damage, loss of data or customer detalis, business income or other damages caused by payment delays, failure to transmit user information, due to restrictions or interruption of ACCESS, unauthorized access, bugs, or other errors.

Termination of Service
  • You have not complied, or you improperly treated our Terms, including any further regulation, or have not met the applicable Romanian law.
  • You provide false registration information
  • You did not answer communications sent by e-mail declared at registration
  • You are engaged in illegal activities
  • We determine that the content is unlawful, offensive, defamatory, threatening or obscene

You can cancel service at any time. In the event of account cancellation you will lose all data related to Your account, and service fees will not be refound.

Conditions

We reserve the right to modify these Terms of Service or terminate our services, for any reason, at any time without notice. Please review these Terms of Service occasionally as they may change in the future.
